COUNTY OF RANDALL That we, DAVID GIBSON HILL and AMARILLO NATIONAL BANK, Amarillo, Texas, a national banking association, as Co-Independent Executors and as Co-Testamentary Trustees under the will of CARL HILL, SR. of Potter county, Texas, and as Co-Trustees of the EDNA WITT HILL Trust of the County of Potter and State of Texas for and in consideration of the sum of TEN AND 10/100 ($10.00) and other valuable consideration, and for the purpose of replacing a lost deed from, CARL HILL and wife Edna Hill, dated the 15th day of March 1977, have GRANTED, SOLD and CONVEYED, and by these presents of GRANT, SELL and CONVEY unto the said JOHN SIMMONS, all that certain lot, tract or parcel of land lying and being situated in Randall County, Texas, and more particularly described as follows, to- wit:

BEGINNING at the Southeast corner of Section No. 178, Block 9, BS&F Survey, Randall County, Texas, THENCE North 00° 08’ 00” East, 660 feet to a point; THENCE West 400 feet to a 1/2” iron rod, the Southwest corner and Beginning Point of this survey; THENCE West 300 feet to a 1/2″ iron rod, the Southwest corner of this survey; THENCE North 00° 08’ 11” East, 1866.1 feet to a 1/2″ iron rod, The Northwest corner of this survey; THENCE East 300 feet to a 1/2″ iron rod, the Northeast corner of this survey; THENCE South 00° 08’ 00” West, 1866.1 feet to a 1/2″ iron rod, the Beginning Point of this survey, and containing 12.852 acres, more or less.
This conveyance is made subject to the restrictions hereinafter set forth, which shall be considered covenants running with the above-described land and will be effective for a period of 20 years from March 15th, 1977 and for successive periods of ten years there-after unless abrogated, modified or changed by the owners of more than half of the above-described land, exclusive of any of such property which may be dedicated for streets, alleyways and easements, which abrogation, modification or change shall be evidenced by written agreement executed by such owners and recorded in the Deed Records of Randall County, Texas, at least one year before the expiration of the initial 20-year period or at least one year before the expiration of the successive 10-year periods, The restrictions are as follows:
(a) The property shall be used for residential purposes only.
(b) No noxious or offensive trade or activity shall be carried on upon the property, nor shall anything be done thereon which may be or may become a nuisance to the neighborhood. covenant to:
(c) No livestock, swine or other animals, except domestic pets or those hereafter allowed, shall be kept, raised or maintained up the premise. No dog kennels are allowed and not more than two (2) dogs shall be kept or maintained on any residential tract located upon the property for any period longer than two (2) months. Poultry may be kept to the rear of any residential dwelling upon a residential tract upon these premises if such rear yard is completely fenced to prevent the bird from straying, and no poultry flock shall ever exceed one hundred (100) birds.
(d) NO part of the property shall ever be used for the storage or display of machinery, merchandise or other materials for sale or trade on a commercial basis. No advertising signs of any kind shall be allowed upon the property, except those customarily used in connection with the on-site advertising and sale of residential real estate.
(e) No houses, house trailers, buildings or structures of any kind are to be moved in or placed upon the property. No trailer, tent, shack, garage, barn or other outbuilding erected upon any tract shall at any time be used either permanently or temporarily as a residence.
(f) Each residence house constructed upon the premises shall have a main area of not less than 1,200 square feet of floor space, exclusive of open porches or garages, and each residence shall have a carport or garage constructed of the same type of material as used in such residence. The carport or garage may be either attached or detached from the house. If detached, the garage or carport shall not be located in front of the house. If attached, the garage or carport may be put in front of the house, but not nearer than forty (40) feet to the front line of
any residential building lot.
(g) The outside of any residence or other structure erected upon any lot must be completed within one (1) year after construction of walls is started. No one shall move into or live in any house until the outside walls of the main residence are finished.
(h) No privies shall be permitted under any circumstances. All individual or privately owned sewage disposal systems upon or serving said land shall be completely underground with on surface outlets. All sewage disposal systems, including pipes, septic tanks, distribution boxes, lateral disposal lines and other such installation shall be good quality and adequately installed to insure that the waste discharged by means of the system:
(1) Does not contaminate any drinking water supply;
(2) Is not accessible to insects, rodents or other possible carriers of disease which may come into contact with food or drinking water;
(3) Is not a health hazard by being accessible to children; and
(4) Dose not give rise to a nuisance due to odor or unsightly appearance.
No other violation or threatened violation of these covenants or restrictions shall be cause for the title to revert to Grantors, their heirs, representatives or assigns, but upon breach or threatened breach of any of such covenants or restrictions, Grantors, their heirs, representatives or assigns, or the owner of any part of the lands hereby conveyed shall have the right to procure injunctive relief without showing that damages have or may result from such breach or threatened breach.
As a part of the consideration for this conveyance, Grantors agree to dedicate an easement to the public for street and roadway purposes on and covering a strip of land along, parallel and adjacent to the westerly side of the above-described tract of land, which shall not be less that 60 feet in width measured at right angles to the westerly line of said tract, when such dedication becomes necessary in connection with the ordinary development of such above – described tract of land.
TO HAVE AND TO HOLD the above-described premises, together with all and singular, the rights and appurtenance thereto in anywise belonging unto the said JOHN SIMMONS, his heirs, executors and administrators, to Warrant and Forever Defend all and singular the said premises unto the said JOHN SIMMONS, his heirs and assigns, against every person whomsoever lawfully claiming., or to claim the same or any part therefore.
